1. The “Golden Trio” of Time of Application Rules
In 2026, there are three specific documents that must exist before you lodge. If you attach them even one day after lodging, your visa will be refused.
#1. The English Language Rule (1-Year Validity)
- The Rule: Your English test (IELTS, PTE, etc.) must be taken within 12 months immediately before the day you apply.
- 2026 Change: The old 3-year validity window is gone. If your test was taken 1 year and 1 day ago, your application is invalid.
- The Requirement: IELTS 6.5 (minimum 5.5 in each band) or PTE 55 (L: 40, R: 42, W: 41, S: 39).
#2. The AFP Character Check Rule
- The Rule: You must provide evidence that you have applied for an Australian Federal Police (AFP) check in the 12 months before you lodge.
- The Mistake: You do not need the result to lodge, but you must have the receipt showing you applied before or on the date of your visa application.
#3. The 6-Month Study Window
- The Rule: You must have met the Australian Study Requirement in the 6 months immediately before the day you apply.
- The Start Date: The 6 months starts from your Official Course Completion Date (when your final results were released), NOT your graduation ceremony date.

3. The 2026 “Decision-Ready” Strategy
In 2026, processing times for the Post-Higher Education Work stream have stayed around 4 to 9 months. Because the Department is dealing with higher fees, they are “Quick-Refusing” applications that aren’t Decision-Ready.
- Step 1: Check your Age. You must be 35 or under on the day you apply (Exceptions: Masters by Research/PhD or HK/BNO passport holders can be under 50). If you turn 36 while the visa is being processed, you are safe—as long as you were 35 on the day of lodgement.
- Step 2: Secure Health Insurance. You must have a valid Overseas Visitor Health Cover (OVHC) policy active at the time of application. You cannot lodge while still on your Student (OSHC) insurance unless you have evidence that your OVHC starts the next day.
4. Why “Visa Hopping” Rules Change Your Timing
As of July 1, 2024 (and continuing through 2026), you can no longer apply for a Student Visa while onshore on a 485.
- The Strategy: This makes the “Time of Application” for your 485 the most important moment of your career. If you lodge your 485 with an expired English test, you cannot “fix” it by applying for a new Student visa. You will likely have to leave Australia.

- Check Test Date: Is my PTE/IELTS less than 12 months old?
- Check Completion Letter: Is today within 6 months of my final results?
