Navigating state migration requirements can feel like aiming at a moving target, especially with the competitive landscape of the 2025–2026 program year.

Investment NSW maintains a clear, strict residency framework for the Skilled Nominated Visa (Subclass 190). To prevent interstate poaching, the state explicitly filters out applicants residing in other Australian states or territories.

The Three Core Residency Pathways

To be eligible for an invite from New South Wales, your Expression of Interest (EOI) must definitively prove that you meet one of these three strict residency criteria:

1. Onshore and Employed

You are currently living in NSW and actively working in your nominated (or closely related) skilled occupation. No minimum employment timeframe is specified, but your employment must be genuine and verifiable via payslips, contracts, and tax records.

2. Onshore and Residing (The 6-Month Rule)

You are currently living in NSW and have continuously resided in the state for a minimum period of six months. Under this specific pathway, you do not necessarily have to be working in your nominated field at the exact moment of invitation—but you must prove you are a genuine resident of the state.

3. Offshore Applicants

You are living outside of Australia and have continuously resided offshore for a minimum period of six months. NSW frequently targets highly skilled offshore professionals to fill immediate talent gaps.

Crucial 2026 Program Status Update

🚨 Vital Notice for Applicants: New South Wales officially exhausted its 2025–2026 nomination quota for the Subclass 190 visa. The program state portal stopped issuing invitations, meaning no further 190 invites will be sent until the federal government hands down the brand new 2026–2027 financial year quotas in July.

While the 190 permanent residency pipeline is temporarily paused, you can still submit or update your SkillSelect EOI in preparation for the fresh July allocation. Alternatively, look into the regional Subclass 491 stream, which remains active for specific pathways.

How to Prove Your NSW Residency

If you are invited under an onshore pathway, you must provide bulletproof evidentiary documents to secure your final state nomination. Case officers look for a clear paper trail:

  • Bank Statements: At least 6 months of transaction histories from your primary account showing daily localized spending (groceries, transport, retail) within NSW.
  • Housing Evidences: Signed residential tenancy agreements, utility connection bills (gas, electricity, internet), or home purchase documents.
  • Employment Links: Solid proof of employment like regular payslips, superannuation contributions, and dynamic Australian Taxation Office (ATO) records.
