No, you cannot transition from a Visitor Visa to full-time study by applying for a Student Visa while onshore in Australia. As of July 1, 2024, the Department of Home Affairs has implemented strict regulations to prevent “visa hopping,” which effectively closes this pathway.
The Current “Offshore Only” Rule
If you are currently in Australia on a Visitor Visa (Subclass 600, 601, or 651), you are no longer permitted to lodge a Student Visa (Subclass 500) application while you are inside the country.
- The Requirement: If your goal is to transition to full-time study, you must depart Australia, return to your home country (or a country where you have legal residence), and lodge your Subclass 500 application from offshore.
- Why the BVB Does Not Help: A Bridging Visa B (BVB) is not a standalone visa you can simply “apply for” to start studying. It is only granted to people who have already lodged a valid substantive visa application in Australia. Because you are barred from lodging a Student Visa application while onshore, you cannot trigger the eligibility process that would lead to a Bridging Visa.
Important Distinctions
- Short-Term Study: While on a Visitor Visa, you are generally permitted to undertake short-term study (e.g., recreational or English language courses) for up to three months. However, this is not “full-time study” in a degree program and does not change your status to a student.
- Bridging Visa Inheritance: Even if you were somehow eligible for a different bridging visa, bridging visas typically “inherit” the conditions of the visa you held immediately before it. If you were on a Visitor Visa (which restricts full-time study), a subsequent bridging visa would likely carry those same restrictive conditions.
What You Should Do
If you have received a Confirmation of Enrolment (CoE) from an Australian institution:
- Do not attempt to apply for a Student Visa while onshore, as it will likely be refused under the new regulations.
- Consult your Offer Letter: Contact your university or college admissions team to inform them of your status and your intention to depart for an offshore application.
- Plan for Offshore Lodgement: Prepare your financial evidence, Genuine Student (GS) statement, and English language requirements to lodge your application once you have returned home.
